1. Agreement
By accessing or using the Maken website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services. Maken is operated by Maken, registered in Amsterdam, the Netherlands.
2. Services
Maken provides AI-powered marketing services including but not limited to paid advertising, search engine optimization, content strategy, email marketing, branding, and website development. Specific deliverables, timelines, and pricing are defined in individual client agreements.
3. Pilot program
Our pilot program offers a 2-month engagement period on any service tier. During this period, either party may terminate the agreement with 14 days written notice. No long-term contract is required during the pilot period. Post-pilot engagements are governed by separate client agreements.
4. Payment terms
Retainer fees are invoiced monthly in advance. Ad spend budgets are managed separately and billed based on actual expenditure. Payment is due within 14 days of invoice date. All prices are listed in euros and exclude VAT unless stated otherwise.
5. Intellectual property
All creative assets, ad copy, and campaign strategies produced by Maken for a client become the client's property upon full payment. Maken retains the right to showcase anonymized results and general methodologies in case studies and marketing materials, unless otherwise agreed in writing.
6. Data & confidentiality
We treat all client data as confidential. We will not share your business data, campaign performance, or strategic information with third parties without your explicit consent. Our data handling practices are detailed in our Privacy Policy.
7. Limitation of liability
While we strive to deliver measurable results, Maken does not guarantee specific revenue outcomes or return on ad spend. Marketing performance depends on many factors including market conditions, product-market fit, and budget allocation. Our liability is limited to the fees paid for the services in question.
8. Website use
You may not reproduce, distribute, or create derivative works from any content on this website without our written permission. We reserve the right to modify or discontinue any part of the website at any time without notice.
9. Governing law
These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or our services shall be submitted to the competent court in Amsterdam.
